VA disability and Chapter 13 Bankruptcy

Question:

Is VA disability considered an income for a chapter 13? Does it need to be on schedule I or J?

Jim's Reply:

Bankruptcy is a very complex process and you really need to be represented by an experienced attorney. Having said that, yes...in most cases you have to use the disability payments to prove that you will have enough total income to show that you are able to meet the requirements of the bankruptcy plan.

I believe that it is required on both Schedule J and Schedule I.

  • PS from StatesideLegal:  Contact your local LRS provider on the "Find Legal Help" directory by phone or email. While some are closed in response to Covid 19, you will hopefully get connected and can request a low-cost consult with a local bankruptcy attorney in your community..  You may also want to reach out to Upsolve to see if you qualify for their bankruptcy support.
