SSDI denial even though 100% P & T for PTSD

Question:

Mr. Jim, My husband is 100% P&T from the Army and from the VA for his PTSD. I helped him apply for SSD and has been denied on the initial without lawyer, and denied 2nd time with lawyer. Why or how is that possible? Any advice would be greatly appreciated.

Jim's Reply:

This isn't at all unusual since the SSA uses entirely different criteria than VA does to determine disability. The usual denial is similar to yours...a mental health rating combined with being under age 55 usually results in the claim being denied. Talk with your lawyer about a long term strategy for obtaining the SSDI benefit.
